Terms of Use
These Terms regulate access and use of the Kavyora platform, a SaaS system intended for the operational management of establishments.
1. Platform identification
Kavyora is available under the Kavyora brand, responsible for the operation of the platform and the relationship with contractors.
The official channel for service, support and requests related to these Terms is suporte@kavyora.com.
2. Acceptance of the Terms
When creating an account, contracting a plan, accessing the ERP, using the queue, calendar, finance, applications or any Kavyora resource, the contracting party declares to have read, understood and accepted these Terms and the Privacy Policy.
Whoever carries out the contract declares that they have the powers to represent the registered establishment or business and are responsible for the veracity of the information provided.
3. Object of the service
Kavyora provides a digital platform for managing businesses, including scheduling, online queues, customer chat, team management, services, product sales, supplies, inventory, purchasing, finance, planning, reports, operational notifications, apps and administration areas.
Kavyora only provides the technology platform. The provision of services offered by the establishment, service to the end consumer, definition of prices, schedules, professionals and availability, execution of services and the relationship with end customers are the sole responsibility of the establishment.
4. Plans, values and hiring
The plans available for new subscriptions are Premium and Platinum. Premium costs R$119.90 per month or R$1,190.00 per year; Platinum costs R$149.90 per month or R$1,490.00 per year, according to the billing option selected when subscribing.
There is no free trial period, minimum loyalty or cancellation penalty. The contractor can request cancellation of the plan, and access will remain available until the end of the already paid cycle.
There are no refunds of amounts paid. In case of cancellation, the plan remains active until the end of the contracted period.
5. Payments and recurring billing
Payments are processed by Stripe, which provides credit card and bank slip options for purchasing Kavyora. Kavyora does not store sensitive card data; storage and processing take place in Stripe's secure environment.
Recurring billing is processed by the payment gateway. Kavyora does not issue invoices at this time, and the contractor is responsible for observing their own tax and accounting obligations.
In case of default, access may be blocked after 10 days of delay. Payment of outstanding amounts may reactivate access, subject to the operational rules available on the platform.
6. Responsibilities of the establishment
The contracting establishment is responsible for:
- maintain correct data on the establishment, staff and services;
- define prices, times, availability and internal rules;
- provide customer service to end customers;
- register and maintain customer data when using this feature;
- use customer data only for legitimate operational purposes;
- protect your accesses, passwords, devices and credentials;
- ensure that your internal users respect these Terms.
7. Kavyora Responsibilities
Kavyora is committed to making the platform available on a best effort basis, maintaining reasonable security measures, preserving isolation between establishments and processing data in accordance with the Privacy Policy.
Kavyora does not guarantee uninterrupted availability, absolute absence of failures, financial results, increase in customers, attendance of end customers, commercial performance or operational success of the establishment.
8. Acceptable Use
It is prohibited to use the platform to:
Kavyora may limit, suspend or terminate access in the event of abuse, operational risk, violation of these Terms, default or misuse of the platform. Reported content may be hidden through an auditable process while records needed for investigation are preserved.
- illegal, fraudulent or abusive practices;
- spam, repetitive or abusive messaging and unsolicited communication;
- harassment, threats, intimidation, stalking, hate speech or discrimination;
- false registration, use of third party identities or misleading information;
- attempt to circumvent payment, billing, blocks or limits;
- reverse engineering, improper copying or unauthorized exploitation of the system;
- misuse of customer, employee or establishment data;
- content that is offensive, discriminatory, illegal or that violates the rights of third parties;
- purposeful overload, attacks, abusive automations or attempts to make the platform unavailable.
9. Contextual chat
The chat is linked to a service queue or appointment and is intended to facilitate operational communication among the establishment, professional and customer. It does not replace the contracted service, the establishment's official channels, emergency services or communications that must legally occur through another channel.
Establishments, professionals and customers are responsible for the content they send and must comply with the law, these Terms and third-party rights. Kavyora does not perform general prior monitoring of messages.
After sending, participants cannot edit or delete messages. Reports may result in review, suspension of the conversation or auditable hiding of content, without erasing records needed for security, investigation, compliance with legal obligations or the establishment, exercise or defense of legal claims.
Chat availability depends on the subscribed plan, establishment settings, the user's blocklist status and the operational cycle of the queue or appointment. In these situations, a conversation may become unavailable or read-only.
The chat does not provide end-to-end encryption. Although security measures are applied during transmission and storage, do not send passwords, full card details, confidential documents, unnecessary medical information or other data that is not required for the service.
10. Communications and notifications
Kavyora will be able to send communications via email, push notifications and, in the future, WhatsApp. Promotional communications may be canceled by the user when available.
Operational notifications related to the queue, schedule, service, account, security, billing and platform operation are necessary for service delivery and may remain active while the user uses the platform. Chat notifications can be muted by conversation or device.
A preview containing message content in a push notification is disabled by default and is only displayed after specific consent on the device. Consent can be withdrawn in the device preferences without preventing use of the chat.
11. Changes to the Platform and Terms
Kavyora may evolve, change, remove or add features over time, preserving, whenever possible, the operational stability of contracted resources.
Relevant changes to these Terms will be communicated to contracting parties by email. Continued use of the platform after communication will represent awareness of the new conditions.
12. Closing and data
After account closure or permanent cancellation, data may be made available to the contracting party upon request through the official support email. Applicable periods vary by data category and are described in the Privacy Policy. Chat content is kept by default for 1,826 days after the conversation ends, subject to the extension or deletion cases described in that Policy and by law.
13. Applicable law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Before taking any legal action, the parties will seek an amicable solution through official service channels.
The court of the district of Curitiba, State of Paraná, is elected to resolve any disputes related to these Terms, unless otherwise provided by law.
